The terms and conditions governing your use of the Trade-Marc website and services.

These Terms of Service ("Terms") govern your access to and use of the Trade-Marc website at www.trade-marc.co.za (the "Website"), and any services offered through it. By accessing, browsing, or using the Website, you agree to be bound by these Terms. If you do not agree, please do not use the Website. These Terms are governed by South African law, including the Consumer Protection Act, 68 of 2008 ("CPA"), the Electronic Communications and Transactions Act, 25 of 2002 ("ECTA"), and common law contract principles.
You may use the Website only for lawful purposes and in accordance with these Terms. You agree not to misuse the Website or interfere with its operation. We grant you a personal, non-exclusive, non-transferable licence to access and use the Website for personal, non-commercial purposes.
You must be at least 18 years of age and legally capable of entering into binding contracts to submit a finance application or purchase a vehicle. By doing so, you represent and warrant that you meet these requirements.
We strive to ensure that vehicle descriptions, specifications, and imagery are accurate at the time of publication. However, descriptions are provided for general information and may not reflect every detail of a specific vehicle. You should inspect the vehicle in person or request further information before proceeding with a purchase.
Vehicles listed on the Website are subject to availability and may be sold, reserved, or withdrawn at any time. We do not guarantee that a listed vehicle is still available at the time of your enquiry.
All prices are quoted in South African Rand (ZAR) and are correct at the time of publication. Prices may change without prior notice. Prices exclude on-the-road costs, licensing, and registration unless expressly stated.
If a pricing error occurs on the Website, we reserve the right to decline or cancel any order or quotation based on the incorrect price and will inform you as soon as practicable. We are under no obligation to honour an incorrectly priced listing.
Vehicle images are for illustration purposes. Actual vehicles may differ in colour, trim, or condition. We are not liable for any discrepancy between images and the actual vehicle.
Any quotation provided through the Website, whether for a vehicle or for finance, is an estimate only and does not constitute a binding offer. A quotation is valid for the period stated on it, or if no period is stated, for seven (7) days from the date of issue.
A vehicle may be reserved upon payment of a deposit, the amount of which we will confirm in writing. Deposits are generally refundable up to a point agreed in writing; once a reservation is converted into a sale or the vehicle is prepared for you, deposits may become non-refundable. The specific terms applicable to your deposit will be set out in writing at the time of reservation.
Submitting a Finance Application through the Website is an expression of interest and does not constitute approval for credit. All finance is subject to assessment and approval by a finance provider. We act as a facilitator and do not grant credit ourselves.
By submitting a Finance Application, you consent to us and our finance provider partners conducting credit bureau checks and verifying the information you have provided, in accordance with the National Credit Act, 34 of 2005.
Payment terms for any vehicle purchase will be set out in the invoice or sale agreement provided to you. Where finance is involved, payment terms are determined by the finance provider and are binding once the finance agreement is signed.
Ownership of a vehicle passes to you only once the full purchase price (or finance payout) has been received and the vehicle has been delivered, and any required registration and licensing have been completed. We retain the right of ownership until all amounts due have been settled in full.
Where nationwide delivery is offered, delivery arrangements, timelines, and any associated costs will be agreed in writing. You may alternatively collect the vehicle from our showroom by appointment. Risk in the vehicle passes to you on delivery or collection.
Where a vehicle is sold with a remaining manufacturer's warranty or an extended warranty, the terms of that warranty apply. Used vehicles may be sold "voetstoots" subject to the protections afforded to consumers under the CPA, which prohibit the exclusion of certain implied warranties. We will disclose the warranty status of each vehicle prior to sale.
Nothing in these Terms limits, restricts, or excludes any statutory rights you have as a consumer under the CPA or any other applicable law. In particular, you retain your rights regarding defective goods, unfair contract terms, and the right to fair and honest dealing. Where goods are found to be defective, you may be entitled to a repair, replacement, or refund as provided for in the CPA.
Vehicle sales are generally final, as motor vehicles are goods that are likely to be used. However, where a vehicle is found to be defective within the applicable period under the CPA, you may be entitled to return the vehicle in accordance with the CPA's provisions on defective goods.
All Content on the Website, including text, logos, graphics, images, and software, is owned by or licensed to Trade-Marc and is protected by South African and international intellectual property laws. You may not copy, reproduce, distribute, or otherwise use any Content without our prior written consent.
You may view and download Content for your personal, non-commercial use only, provided that you do not modify the Content or remove any notices.

We strive to maintain the Website's availability but do not guarantee uninterrupted access. We may suspend or restrict access for maintenance, updates, or reasons beyond our control. We are not liable for any loss arising from the Website being unavailable.
To the maximum extent permitted by law, our liability for any claim arising out of or in connection with your use of the Website is limited to the amount you paid us for the relevant transaction, or where no amount was paid, to R1,000.00. We are not liable for indirect, incidental, consequential, or special damages, or for loss of profits or data. This limitation does not apply to liability that cannot be excluded under the CPA or other applicable law, including liability for death or personal injury caused by our negligence or for fraud.
You agree to indemnify and hold Trade-Marc harmless from any claims, damages, losses, or expenses (including legal costs) arising from your breach of these Terms, your misuse of the Website, or your violation of any law or third-party rights.
We are not liable for any failure or delay in performing our obligations where such failure or delay is caused by events beyond our reasonable control, including natural disasters, strikes, network failures, government action, or other circumstances of force majeure.
The Website may contain links to third-party websites. We are not responsible for the content, privacy practices, or terms of any third-party website. Your use of third-party websites is at your own risk.
These Terms are governed by and construed in accordance with the laws of the Republic of South Africa. Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of South Africa, unless otherwise required by the CPA.
If any provision of these Terms is held to be invalid, illegal, or unenforceable, that provision shall be severed and the remaining provisions shall remain in full force and effect.
We may amend these Terms at any time by posting an updated version on the Website. The "Last Updated" date indicates when the Terms were last revised. Your continued use of the Website after amendments constitutes acceptance of the revised Terms.
